Please read these Terms of Service ("Terms") carefully before using Sakhi ("Service", "we", "us", "our"). By accessing or using Sakhi, you agree to be bound by these Terms. If you do not agree, do not use the Service.

SAKHI IS AN ARTIFICIAL INTELLIGENCE (AI) ASSISTANT.

Sakhi is NOT a human being. Sakhi is NOT a licensed medical professional, therapist, psychiatrist, psychologist, counselor, financial advisor, lawyer, or any other licensed professional.

DO NOT USE SAKHI FOR EMERGENCIES. If you are experiencing a medical emergency, mental health crisis, or any life-threatening situation, immediately call emergency services (112 in India) or go to your nearest emergency room.

1. Nature of the Service

1.1 AI-Powered Assistant

Sakhi is an artificial intelligence-powered conversational assistant designed to provide:

General emotional support and companionship
Lifestyle information and recommendations
General wellness guidance
Information about services, products, and experiences

1.2 What Sakhi Is NOT

Sakhi is expressly NOT any of the following:

A medical device or healthcare provider
A licensed therapist, psychiatrist, psychologist, or mental health professional
A licensed financial advisor, accountant, or investment professional
A licensed attorney or legal professional
A substitute for professional medical, mental health, financial, or legal advice
An emergency service or crisis intervention service
A human being or real person

2. Important Disclaimers

BY USING SAKHI, YOU ACKNOWLEDGE AND AGREE TO ALL DISCLAIMERS IN THIS SECTION.

2.1 No Medical Advice

SAKHI DOES NOT PROVIDE MEDICAL ADVICE. Any health-related information provided by Sakhi is for general informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something Sakhi has said.

Sakhi cannot and will not:

Diagnose any medical or health condition
Prescribe or recommend specific medications or dosages

Provide advice on medication interactions or side effects

2.2 No Mental Health Treatment

SAKHI IS NOT A THERAPIST AND DOES NOT PROVIDE MENTAL HEALTH TREATMENT. Sakhi is not a substitute for professional mental health care. Using Sakhi does not create a therapist-client relationship, doctor-patient relationship, or any other professional clinical relationship.

Sakhi cannot and will not:

Recommend specific investments or asset allocations
Provide tax planning or tax evasion strategies
Advise on specific financial products or instruments
Guarantee any investment returns or outcomes
Replace consultation with qualified financial professionals

2.4 No Legal Advice

SAKHI DOES NOT PROVIDE LEGAL ADVICE. Using Sakhi does not create an attorney-client relationship. Any legal information provided is general in nature and may not apply to your specific situation. Laws vary by jurisdiction and change frequently.

2.5 AI Limitations and Accuracy

SAKHI MAY PRODUCE INACCURATE, INCOMPLETE, OR MISLEADING INFORMATION. As an AI system, Sakhi:

May generate responses that contain errors or inaccuracies
May "hallucinate" information that sounds plausible but is false
Has knowledge limitations and may not have current information
May misunderstand context or nuance in your questions
Cannot verify the accuracy of information it provides
May reflect biases present in its training data

2.6 No Booking or Transaction Capability

Sakhi cannot make reservations, bookings, purchases, or any other transactions on your behalf. Any recommendations provided are for informational purposes only, and you must independently contact service providers to make arrangements.

3. Prohibited Uses

You agree NOT to use Sakhi for:

Emergency situations or time-sensitive health/safety issues
Obtaining medical diagnoses or treatment recommendations
Making critical financial, legal, or life decisions without professional consultation
Any illegal activities or purposes
Planning or facilitating illegal activities including but not limited to:
- Child marriage (illegal under Prohibition of Child Marriage Act, 2006)
- Dowry transactions (illegal under Dowry Prohibition Act, 1961)
- Caste-based discrimination
- Tax evasion or money laundering
- Obtaining controlled substances without prescription
- Any violation of Indian law
Harassment, abuse, or harm to others
Generating content that is defamatory, obscene, or illegal

4. Eligibility

By using Sakhi, you represent and warrant that:

You are at least 18 years of age
You have the legal capacity to enter into these Terms
You are not prohibited from using the Service under applicable law

5. Recording and Data Collection

YOUR CONVERSATIONS WITH SAKHI ARE RECORDED. By using the Service, you consent to:

Recording of voice conversations
Storage of conversation transcripts
Use of conversation data to improve the Service
Analysis of conversations for quality and safety purposes

6. Communications and Marketing

By creating an account with Sakhi, you agree to receive:

Service-related communications - Essential emails including account verification, password reset, security alerts, and important service updates
Promotional communications - Emails about new Sakhi features, special offers, wellness tips, and exclusive content curated for our community

Unsubscribe at any time: You can opt out of promotional emails by clicking the "unsubscribe" link at the bottom of any marketing email. Service-related emails cannot be opted out of while your account is active.

7. Limitation of Liability

IMPORTANT - PLEASE READ CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAKHI AND ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any direct, indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or goodwill
Any physical injury, emotional distress, or psychological harm
Any decisions made or actions taken based on information provided by Sakhi
Any errors, inaccuracies, or omissions in Sakhi's responses
Any unauthorized access to or alteration of your data
Any interruption or cessation of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION
UNINTERRUPTED OR ERROR-FREE OPERATION

9. Indemnification

You agree to indemnify, defend, and hold harmless Sakhi and its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Any claim that your use of the Service caused damage to a third party

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted in Mumbai, India. The language of arbitration shall be English.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
